2. Product & Service Description

We take pride in offering healthy, well-established plants. Our product range includes specific categories such as:

• Groundcovers (from 3 Inch and Under to 12 Inch Or Taller)
• Trees (Apple & Crabapple Trees, Fig Trees)
• Berry Plants (Blackberry, Aronia, Chokeberry)
• Vines (Clematis, Climbing Hydrangea, Edible Vines)

We strive for accurate descriptions and photography. However, slight natural variations in size, leaf color, or branching may occur, as each plant is unique. Seasonal availability affects stock.

3. Ordering & Payment Terms

Placing an order constitutes an offer to purchase.

• Order Processing: Orders are processed within 1-2 business days after payment confirmation.
• Payment Methods: We accept Visa, MasterCard, JCB, and PayPal. Payment is due at the time of order.
• Pricing & Taxes: Prices are listed in US Dollars. You are responsible for any customs duties, taxes, or fees imposed by your country’s import regulations.
• Order Acceptance: We reserve the right to refuse or cancel any order for reasons including, but not limited to, product availability, errors in pricing, or suspicion of fraudulent activity.

4. Shipping Policy

We ship globally, excluding some remote areas and parts of Asia. Availability will be confirmed at checkout.

• Standard Shipping: Via DHL/FedEx. $12.95 flat rate. Delivery in 10-15 business days after shipment.
• Free Shipping: Via EMS. FREE on orders over $50. Delivery in 15-25 business days after shipment. Not available for orders under $50.
• Customer Duty Upon Arrival: You must promptly open the package, check the plants, and provide initial care (gentle watering if dry, appropriate light) as you prepare to plant. Delay can compromise plant health.

5. Returns, Exchanges & Guarantee

Our guarantee reflects our commitment to your gardening success.

• Guarantee Period: All return/exchange requests must be initiated within 15 days of receiving your shipment.
• Process: Contact us at [email protected] with your order number and details/photos. Do not ship plants back without our authorization. Upon receipt and inspection, we will issue a replacement (if available) or refund the plant purchase price.
• Non-Refundable: Original shipping fees are non-refundable unless the error was ours. Refunds are issued to the original payment method within 5-10 business days after we receive the return.
• Non-Returnable Situations:
  • Requests made after the 15-day period.
  • Issues arising from improper planting, unsuitable local climate, pest damage after delivery, or inadequate care (watering, sunlight, etc.).
  • Items marked “Final Sale.”

6. User Responsibilities & Limitations of Liability

Your Responsibilities: You are responsible for:

• Providing accurate shipping and contact information.
• Understanding your local climate, soil conditions, and plant hardiness zones to select suitable plants (e.g., ensuring Drought Tolerant Groundcovers match your environment).
• Providing appropriate post-arrival and long-term care for your plants.
• Complying with all local laws regarding plant importation.

Limitation of Liability: Wilson Bros Garden’s liability is limited to the purchase price of the plant in question. We are not liable for any indirect, incidental, or consequential damages, including plant loss after delivery due to the factors listed in section 5, acts of nature, or carrier delays beyond our control.

Even beyond the return period, we are here to help. Our team includes experienced gardeners who may offer advice to help your Berry Plants or Flowering Vines thrive. We value your trust and are committed to your long-term satisfaction.
